            President Nancy Kinnersley called the meeting to order.

MINUTES for April 23, 2009 were approved.

REPORT OF THE FACULTY SENATE PRESIDENT
            Nancy Kinnersley thanked Senate members and Molly Mulloy and Kathy Reed in the University Governance office.

TECHNICAL AMENDMENT TO FSRR 6.2.1.2
            Lisa Wolf Wendel/Gitti Salami moved that the amendment be approved. Passed. The changes are shown in bold/strikeout font:

ARTICLE VI.
Section 2. Promotion and Tenure Standards
6.2.1.2.  Teaching faculty may hold the rank of assistant professor, associate professor, or (full) professor.  For purposes of promotion and tenure:
          (a) assistant librarian I, assistant research or clinical professor, and assistant scientist, curator, or specialist are equivalent in rank to assistant professor;
(b) associate librarian II, associate research or clinical professor; and associate scientist, curator, or specialist are equivalent in rank to associate professor; and
(c) librarian III, research or clinical professor, and senior scientist, curator, or specialist are equivalent in rank to (full) professor. 

OLD BUSINESS
Revised Policy on Open Access to KU Scholarship
Ada Emmett/John Stratton moved to endorse the revised policy distributed for today’s meeting.
In the discussion that followed, Lisa Wolf-Wendel/Liz Kowalchuk moved to amend the motion by eliminating the word “implemented” at the end of the last paragraph. Vote on the amendment passed, with one opposed.
Nancy Kinnersley clarified that implementation details could be worked out later by Faculty Governance, but the Senate was being asked to vote on the concept of the Open Access Policy today. She noted that most faculty who emailed her about the policy were in favor of the concept but had questions about implementation details. Lisa Wolf-Wendel added that  representatives from FacEx met with Vice Provost for Research Steve Warren and the Provost who agreed that it would be important to determine if there is faculty support for the general concept of the policy. In response to a question, Ada Emmett, a member of the Research Committee’s sub-committee that developed the policy, noted that an earlier version included procedures for implementation and her subcommittee favored a more robust policy, but FacEx did not agree.
Rodolfo Torres explained why he was not in favor of the “opt out” option and preferred an “opt in” option.  He said it would be too onerous for a faculty member to have to opt out for every journal article. John Stratton said when implementation details are being discussed later, it will be important to consider concerns such as those expressed by Torres.
            Mark Ezell/Chuck Marsh moved to amend the proposal by changing the word “policy” to “concept” at the end of the first paragraph and by adding the words “which will be submitted for approval by the Faculty Senate”  at the end of the second paragraph. Passed by a vote of 11 to 10. 
            The vote on the entire policy, as amended, passed with one opposed and one abstention.   The final text is as follows:

The faculty of the University of Kansas (KU) is committed to sharing the
Intellectual fruits of its research and scholarship as widely as possible and lowering barriers to its access.  In recognition of that commitment and responsibility, the KU faculty is determined to take advantage of new technologies to increase access to its work by the citizens of Kansas and scholars, educators, and policymakers worldwide.  In support of greater openness in scholarly endeavors, the KU faculty agrees to the following concept:

            Each faculty member grants to KU permission to make scholarly articles to which he or she made substantial intellectual contributions publicly available in the KU open access institutional repository, and to exercise the copyright in those articles.  In legal terms, the permission granted by each faculty member is a nonexclusive, irrevocable, paid-up, worldwide license to exercise any and all rights under copyright relating to each of his or her scholarly articles, in any medium, and to authorize others to do the same, provided that the articles are not sold for a profit.  This license in no way interferes with the rights of the KU faculty author as the copyright holder of the work.  The policy will apply to all scholarly articles authored or co-authored while a faculty member of KU.  Faculty will be afforded an opt out opportunity.  Faculty governance in consultation with the Provost’s office will develop the details of the policy which will be submitted for approval by the Faculty Senate. 

            Nancy Kinnersley recognized and thanked members who were ending their terms on Faculty Senate this year.
